		<description>Hello everyone...I come here tonight to read some hard hitting senate controversey commentary and find...none. So disappointing.

So let me begin with some thoughts:

1) If Rod Blagojevich was on the Titanic he might have found a way to keep it afloat. He is a crazy bastard and has gone on the offense.

2) By doing so, by not only playing the race card but by reinvigorating the quickly dying divisive Black-power/Black-preservation politics of the past that relies on white guilt to thrive, Blago proves he cares not about Illinois.

3) This will be interesting to see if a) any blacks still possess this mindset and defend the appointment and b) if they feel betrayed by Obama because he does not. The first black people versus black president controversey ever...and he&#039;s not even president yet. 

4) Amendment 17 says &quot;When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.&quot;

Does there seem to be a preference for writs of election over temporary appointment? Or is temporary appointment a constitutional requirement inbetween vacancy and special election? If the legislature were to void their empowerment of the executive with such a duty...say...tomorrow...is the appointment still valid? Or is the temporary simply the replacement until the election? 

5) Article 1 says the Senate may make their own rules for proceedings. They can refuse to seat Burris. Powell v. McCormack 395 US 486 (1969) is the only case law close to on point. But that deals with the House refusing to seat an elected member under a &quot;qualifications&quot; argument. Burris is neither elected, nor is the argument about his personal qualifications. Rather, the issue lies in the tainted appointment process. 

Who else sees a 5-4 decision written by Kennedy affirming the Senate&#039;s right to not seat Burris? 

By then, will the legislature get its head out of its ass and approve a special election date? Finish impeachment? The criminal proceeding certainly wouldn&#039;t be complete by then...

But tonight, we have Christine Radogno on TV praising the election of Barack Obama. I suppose we can&#039;t count on her to muster up support for and attention to the need for an election.

It&#039;s just a mess. I&#039;m moving to Tennessee.</description>
